Terms of Service & Rental Agreement

To create an account and use our services, you must review and accept these Terms of Service and our Privacy Policy. Please read all sections carefully. For questions, contact our support team.

1. Platform Nature & Liability Scope

SelfDriveBLR is a technology marketplace platform, not a car rental company. We connect vehicle owners ("Partners") with customers seeking self-drive rentals ("Renters"). SelfDriveBLR does not own, operate, or maintain the vehicles listed on the platform. We facilitate bookings, payments, and provide technology infrastructure.

The rental agreement is directly between the Renter and the Partner. SelfDriveBLR acts as a technology intermediary platform and liability shall be limited to the extent permissible under applicable law. We are not responsible for the condition, availability, or performance of any vehicle listed on the platform, except as required by applicable consumer protection laws.

2. GPS Tracking & Telemetry Consent

Required

By booking a vehicle, you expressly consent to:

  • Real-time GPS tracking of the vehicle during the rental period for safety, security, and operational purposes
  • Trip telemetry collection including speed, distance, location history, and driving patterns
  • Location sharing with the partner for pickup coordination and vehicle monitoring
  • Data sharing with law enforcement when legally required or in case of suspected theft, accident, or violation
  • Geofence alerts if vehicle exits authorized areas or enters prohibited zones

Tracking data is retained only as long as necessary for operational, legal, and security purposes. You may request access to your trip data through customer support.

3. Law Enforcement & Legal Sharing

Required

You authorize SelfDriveBLR to:

  • Share your booking records, KYC documents, GPS data, payment information, and trip history with law enforcement authorities upon lawful request (court order, FIR, or official investigation)
  • Cooperate fully with police investigations regarding accidents, theft, traffic violations, or criminal activity
  • Provide evidence including photos, communications, and transaction records in legal proceedings
  • Comply with summons, warrants, and legal notices as required by Indian law

This authorization is irrevocable and survives account closure to the extent permitted by law for ongoing investigations or legal proceedings.

4. Driver Eligibility & Requirements

Required

By booking a vehicle, you confirm and agree that:

  • You are at least 21 years of age
  • You hold a valid Indian Driving License (DL) for minimum 1 year
  • Your DL is valid for the entire rental period
  • You will present the original physical DL at vehicle pickup (digital copies not accepted)
  • The name on the DL matches the booking name
  • You have not been convicted of any serious traffic violations
  • You are not under the influence of alcohol or drugs at pickup or during rental

Failure to produce a valid original DL will result in booking cancellation with no refund.

5. Vehicle Handover Refusal Rights

Required

Partner or SelfDriveBLR reserve the right to deny vehicle handover if the renter:

  • Appears intoxicated, under the influence of alcohol/drugs, or unable to safely operate the vehicle
  • Displays abusive, threatening, or harassing behavior toward partner or staff
  • Cannot produce valid original documentation (DL, ID proof)
  • Refuses to complete mandatory pre-trip inspection or documentation
  • Appears unfit to drive due to medical condition, fatigue, or other safety concerns
  • Attempts to use the vehicle for purposes other than declared at booking

In such cases, the booking will be cancelled with no refund. Repeat violations may result in permanent platform suspension.

6. Rental Agreement Terms

Required

Each booking creates a binding rental agreement with the following terms:

  • Vehicle Usage: Vehicle is for personal use only. No commercial use, sub-leasing, or allowing unauthorized drivers.
  • Geographic Limits: Standard bookings are for Karnataka state. Outstation trips require:
    • Prior written approval from partner at booking
    • Valid interstate permits (if applicable)
    • Insurance coverage verification for destination state
    • Additional security deposit may apply
  • Unauthorized Outstation Use: Trips outside Karnataka without approval may result in immediate trip termination, vehicle recovery, forfeiture of security deposit, and insurance voidance - renter assumes full liability.
  • Prohibited Uses: No off-road driving, racing, towing, or transporting illegal goods.
  • Pickup/Drop Timing: 30-minute grace period. After 30 minutes, booking may be cancelled by partner.
  • Traffic Violations: All challans during rental period are renter's financial responsibility.
  • Accidents: Must be reported within 1 hour to partner and SelfDriveBLR support. Police report required.
  • Breakdowns: Contact partner immediately. Do not attempt unauthorized repairs.

7. Pricing, Payments & Deposits

Required

Price Breakdown:

  • Base rental charges (as shown at booking) - inclusive of all applicable taxes
  • Security deposit (varies by car type, collected at pickup)

What's Included:

  • Vehicle rental for selected duration
  • Basic third-party insurance coverage
  • Roadside assistance during rental period
  • 24/7 customer support

Additional Charges (if applicable):

  • Extra KM beyond included limit: ₹12-15 per km
  • Late Return: ₹500 per hour or part thereof
  • Fuel Shortfall: ₹120 per litre
  • Cleaning Fee: ₹500-2000 (for excessive dirt/stains)
  • Smoking Fee: ₹2000 (evidence of smoking in vehicle)
  • Toll Charges: Actual tolls incurred during trip
  • Traffic Violations: Actual challan amounts

Security Deposit:

  • Security deposit collected at vehicle pickup (amount varies by car type: cash/UPI/card)
  • Refunded at drop-off after vehicle inspection
  • Deductions may apply for damages, fuel shortfall, or violations
  • Refund processed immediately for cash/UPI, 3-5 days for cards

Payment Terms:

  • Full rental amount due at booking confirmation
  • Security deposit due at pickup
  • Accepted: UPI, Credit/Debit Cards, Net Banking
  • Prices shown are final - no additional taxes or fees added at checkout

8. Cancellation & Refund Policy

Required

Cancellation by Renter:

  • 24 hours before pickup: 50% refund of rental charges
  • Less than 12 hours before pickup: No refund
  • After pickup (no-show): No refund
  • Early return: No refund for unused days

Cancellation by Partner:

  • If partner cancels, full refund to original payment method
  • SelfDriveBLR will assist in finding alternative vehicle
  • Compensation may be offered at platform's discretion

Refund Processing:

  • Refunds processed within 5-7 business days to original payment method
  • Bank processing times may add 2-3 additional days
  • Security deposit refunded separately at drop-off
  • No deductions from rental refunds for cancellations

9. Damage Liability & Insurance

Required

Your Liability:

  • You are responsible for the vehicle during the rental period
  • Standard liability: Security deposit (amount varies by car type) deductible applies to approved insurance claims
  • Extended Liability: Renter liability may extend beyond the security deposit in cases involving:
    • Negligence, intoxication, or reckless driving
    • Unauthorized usage or violation of rental terms
    • Insurance claim rejection due to renter actions
    • Material breach of rental agreement
    • Driving under influence of alcohol/drugs
    • Off-road use, racing, or prohibited activities
  • In such cases, renter is liable for actual repair costs, third-party damages, and associated legal costs

Basic Insurance Coverage (Included):

  • Third-party liability coverage as required by Indian Motor Vehicles Act
  • Own damage coverage subject to insurer approval, policy terms, exclusions, and investigation outcomes
  • Standard deductible: Security deposit amount (varies by car type) per approved claim
  • Coverage is subject to insurer approval and investigation - claims may be rejected
  • Maximum claim limits as per partner's insurance policy terms

NOT Covered by Insurance (Renter Pays Full Cost):

  • Tyre, wheel, or rim damage
  • Interior damage (stains, burns, tears, odors)
  • Driving under influence of alcohol/drugs
  • Unauthorized driver operating vehicle
  • Off-road or racing use
  • Negligence (keys left in car, unlocked vehicle)
  • Personal belongings theft from vehicle
  • Damage due to violation of rental agreement terms
  • Any damage where insurance claim is rejected due to renter actions

Trip Evidence & Documentation:

  • Timestamped photos required before and after trip (mandatory for both parties)
  • Odometer reading recorded at pickup and drop-off with GPS metadata
  • Fuel level documented with photo evidence
  • Both renter and partner must sign inspection report
  • Auto-upload of evidence required before trip activation
  • Disputes resolved through SelfDriveBLR support with evidence review
  • Final decision based on photo evidence, GPS logs, and inspection reports
  • Refusal to complete documentation may result in booking cancellation

10. Fuel Policy

  • Vehicle must be returned with the same fuel level as at pickup
  • Fuel level documented with photo at handover (mandatory)
  • Shortfall charged at ₹120 per litre (market rate)
  • No refund for excess fuel returned
  • Electric vehicles: Return with same charge percentage as pickup

11. Privacy, KYC & Data Usage

Required

KYC Documents Required:

  • Driving License (front and back) - original required at pickup
  • Aadhaar Card (for Indian residents) or Passport (for foreigners)
  • Documents must be clear, legible, and unexpired
  • Screenshots or photocopies not accepted for KYC

Data Usage & Retention:

  • Documents used solely for verification and regulatory compliance
  • Data shared with partner for booking fulfillment only (Aadhaar masked/document access temporary)
  • Stored securely with industry-standard encryption and access controls
  • Retained only as long as legally required or reasonably necessary for fraud prevention, dispute resolution, taxation, and regulatory compliance
  • You have the right to request data deletion (with regulatory exceptions for required retention periods)
  • Aadhaar numbers are masked in displays; full documents accessed via temporary signed URLs only

Consent:

By uploading documents, you consent to:

  • Verification against government databases (where applicable)
  • Sharing with the partner whose vehicle you book
  • Use for fraud prevention, security, and legal compliance

12. Platform Rights & Account Actions

Required

SelfDriveBLR reserves the right to:

  • Suspend or terminate user accounts without prior notice for violations of these terms
  • Reject or cancel bookings if fraud, abuse, or policy violations are suspected
  • Block devices or IP addresses associated with suspicious activity
  • Retain all evidence including communications, photos, GPS logs, and transaction records
  • Cooperate with law enforcement and provide data as legally required
  • Report fraudulent activity to relevant authorities and credit bureaus
  • Withhold refunds or security deposits pending investigation of disputes
  • Modify or update these terms with reasonable notice to users

Account suspension may be temporary or permanent depending on violation severity. Suspended users may be prohibited from creating new accounts.

13. Vehicle Recovery Authorization

Required

You authorize SelfDriveBLR and the Partner to:

  • Remotely track and locate the vehicle using GPS technology at any time during the rental period
  • Recover the vehicle without prior notice in cases of:
    • Suspected theft, fraud, or criminal activity
    • Vehicle abandonment or failure to return as agreed
    • Non-payment of rental charges or damages
    • Violation of geographic restrictions or rental terms
    • Insurance voidance or unauthorized usage
  • Disable vehicle ignition or access remotely where technology permits (subject to safety regulations)
  • Engage law enforcement or recovery services as necessary
  • Charge all recovery costs to the renter including towing, legal fees, and personnel costs

Recovery actions will be conducted in compliance with applicable laws. You waive any claims related to lawful vehicle recovery actions.

14. Acceptable Conduct & Abuse Policy

Required

Prohibited Conduct:

  • Abusive, threatening, or harassing behavior toward SelfDriveBLR staff, partners, or other users
  • Verbal or physical abuse during pickup, drop-off, or support interactions
  • Fraudulent bookings, false claims, or manipulation of platform systems
  • Coercive demands for refunds, compensation, or service modifications
  • Social media defamation or false public statements about the platform or partners
  • Bullying, intimidation, or discriminatory behavior

Consequences: Any abusive conduct may result in immediate booking cancellation, permanent account suspension, legal action for damages, and reporting to appropriate authorities. All customer service calls may be recorded for quality and evidence purposes.

15. Inherent Risk Assumption

Required

By proceeding with the booking, you acknowledge that motor vehicle usage involves inherent risks including:

  • Accidents, collisions, and bodily injury
  • Mechanical failure, breakdowns, or tire damage
  • Theft, vandalism, or third-party criminal acts
  • Weather-related hazards and road conditions
  • Actions of other drivers and pedestrians
  • Traffic violations and legal consequences

You voluntarily assume all such risks to the maximum extent permitted under applicable law. You are solely responsible for safe vehicle operation and compliance with all traffic laws. SelfDriveBLR and Partners are not responsible for accidents, injuries, or losses arising from your driving actions, negligence, or third-party conduct during the rental period.

16. Payment Disputes & Fraud Prevention

Required

Prohibited Payment Actions:

  • Fraudulent payment disputes or chargebacks after successful service delivery
  • False claims of unauthorized transactions
  • Use of stolen payment instruments or fraudulent cards
  • Payment reversals to avoid legitimate charges for damages or violations

Consequences: Fraudulent chargebacks or payment disputes may result in:

  • Immediate permanent account suspension
  • Legal recovery proceedings for disputed amounts plus costs
  • Reporting to credit bureaus and fraud databases
  • Criminal prosecution where applicable
  • Forfeiture of any pending refunds or credits

All payment transactions are logged with IP addresses, device fingerprints, and timestamps for fraud investigation purposes.

17. Dispute Resolution & Jurisdiction

  • Governing Law: Laws of India and Karnataka state
  • Jurisdiction: Courts in Bangalore, Karnataka exclusively
  • Dispute Process: Contact support first for resolution within 7 days
  • Arbitration: Unresolved disputes subject to arbitration under Indian Arbitration Act, 1996
  • Limitation: Claims must be filed within 1 year of incident date

18. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including: natural disasters, government actions, wars, terrorism, pandemics, strikes, or internet/telecommunication failures.

In such cases, bookings may be rescheduled or refunded at SelfDriveBLR's discretion based on the specific circumstances.
